A victim can be anyone who has suffered physical or emotional trauma. Friends and family of murder victims are also considered to be victims. I'm sure you aren't doing this directly or intentionally, however, telling someone that they're not a victim just victimizes them all over again and it minimizes their trauma. You are telling your entire audience that this girl is not a victim of anything when she most certainly is. Why does it bother you so much that people are labeling her as a victim anyway? Try to remember, she is going to have this trauma and survivor's guilt for the rest of her life. The world already has their eyes on her, she's got a ton of pressure on her being as she'll probably be the prosecution's star witness. She's going to need therapy and we have no idea how this will effect her future. She is absolutely a victim of Bryan's actions….yes, she's a surviving victim, but she's a victim nonetheless.

I invite you to do a little more research (not just Googling "the definition of a victim" and reading off the first one you see) before determining who is or isn't a victim. The United Nations' Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power is a good place to start.
