Other diver flag laws include:
1. Divers must surface within 100 feet of the marker
2. Boats must remain at least 100 feet from the flag in all directions
3. Divers should not place a flag in an area already occupied by other boaters or where their diving operation will impede the normal flow of waterway traffic.

Probably a delivery jock. Some of the most arrogant inconsiderate pricks on the waterway. They give no fcks about anyone or anything that would cause them to lose a half minute off their delivery time. They are the boils on the rectum of the ICW. Guaranteed they were % aware of the dive flags, and yes , there are specific rules (27(e) ii ) addressing underwater operations. The vessel should be reported, that's an egregious violation of common sense, rules notwithstanding.
