    The motor yacht should have turned to starboard miles earlier as he is the give way vessel. The ferry could have called ( the motor yacht) via vhf to ask their intentions. It beggars belief, that seeing both vessels are on a constant bearing, neither party took avoiding action.

    Alone 50 men became super billionär in the cov-crises. And many buy supper jachts and ships. But where do they find good captains and good personal? As more super jachts are in the water as more ships will sink burn or crush in others.
    Ship inflation will lead to ship damage because of not qualified personal

    Have I missed something ? The superyacht slowed as per regulations took action to avoid collision. How may I ask were the superyacht crew to know that the passenger ferry would subsequently slow down as well.

    AIS appear to show the captain slowing down and steering towards starboard. The ferry responded by slowing down himself

    Is it not reasonable for the crew to expect the ferry to continue at speed (as per regulations) which would in the eyes of the yacht captain have resulted in the yacht passing astern

    Obvious fault of the so called super yacht. Nowadays, some of these called super yachts are operated by extremely incompetent crews. They think if they are on multimillion dollar yacht, that everyone has to sray away from them. Zero seamanship skills!

    The ferry was the stand on vessel, and the MY was the give way vessel. Simple seamanship.

    Arrogant super yacht captain on auto pilot not on the bridge with binoculars scanning for traffic.
    Do these massive super yachts not have a collision avoidance system, that should’ve picked up that ferry and its course half a mile before almost impact.

    The nautical Right of Way is defined as being from 0 dg to 135 dg, or 45 dg abaft of the starboard beam. Anything approaching within that sector has the right of way over you – that, which is the actual meaning of Rule 15, is unconditional. The Yacht was totally in the wrong – period. They had the absolute obligation to turn to the starboard on the approach, so as to set a heading taking them behind the ferry. Geoff Rohde

    Having watched the AIS replay a few times I actually think the blame was more on the superyacht but the ferry was not blameless. The ferry certainly had right of way and it appears that Bleu de Nimes slowed down to let the ferry pass ahead. With the superyacht slowing down the ferry would have easily passed ahead if it had maintained course and speed. The superyacht, however, only slowed down but did not alter course to make it obvious that they were taking avoiding action. It appears that the captain of the ferry, being unsure of the intentions of the superyacht, performed an emergency stop. You can apportion blame to the superyacht for not making a substantial change of course to signal that they were taking avoiding action, but also to the ferry for not maintaining course and speed. I would speculate that if the captain of the ferry was only eyeballing the superyacht, not using electronic aids, he may have been confused by the superyacht not altering course. Of course we don't know the full facts but normally the ferry captain should have been using all available equipment including AIS and Radar, as well as calling on the VHF, and you would think he should have known that the superyacht had slowed and there was no need to stop.

    Rule of the Roads, you had to be word perfect when going up for your "orals" (examination 😉) as these are a legal document. The only trouble with being involved in a collision at sea you're both to blame. It just up to the Court of inquiry to decide what proportion of blame gets asigned to each ship. I know from experience unfortunately where a cargo vessel collided into the port side of the jack-up rig I was towing in a TSS. 😖

    The ferry had right of way – it is a working boat. The yacht should have gone hard astern or turned away.
