Large boat should face negligence charges the overtaking vessel is the burdened vessel. He has to stand clear the small craft was the stand on which means that you maintain your course and speed the overtaking vessel is always the burdened or steer clear vessel.

The yacht obviously has right of way. It seems to be towing a tender of some sort astern, therefore severely limiting its maneuverability
This video reminded me of a night we were doing boats ops in Subic Bay many years ago while in the Marines . We had a straight shot to the beach , though noticing some lights from another craft that would be passing our path . We gunned our rubber boats thinking no problem . What turned out to be a tanker was going way faster than anticipated and we had to turn off and loop around . Moral of the story is keep the ego in check and give a wide space to the bigger boat .

the yacht did NOT cause the small boat to sink, it was already in trouble and the yacht avoided hitting it and went by at a safe as possible speed
The only rule I follow, "Move, Bitch! Get out the way! Get out the way, Bitch! Get out the way!"
The small boat have the right way. The yacht is coming from behind at greater speed and should change it’s course by at least 30 degrees or more to avoid the small boat. If it’s a narrow passage, the yacht should reduce the speed and stay behind the small boat until he can make a safe passage. This is a 100% clear case.
He was swamped before the yacht came

The little boat was on the big boats port side which is red so should give way.

For one thing the guy in the little boat didn't know how to operate his craft properly that should have never happened

So if you stubbornly think you have the right of way you just keep going and destroy your boat and possibly kill or injure yourself. Unbelievable! The yacht captain probably didn't see him and the smaller boat is more maneuverable than the giant yacht anyway.
