This just sounds like standard government BS, the law's quite clear if the vessel is seized it's the government's responsiblity to pay for its upkeep and the crew so the owner is not liable….

In general, it seems as if there are always some "shady" things going on in the super yacht world – perhaps somewhat similar to what goes on in the world of fine art, classic cars, jewellery, and real estate… basically in any sector where large amounts of money is involved! I'm certainly not saying that rich people are by definition "bad" – not at all. Many others are willing to benefit from the cash flows, e.g. the finance and insurance sectors – both of which are not always above board. Certain governments are known to participate in "creative" business dealings too…
That's why I sympathise with any crew of a super yacht that hasn't been paid. It's seems unfair if crews are denied their salaries, especially in a world where many millions of dollars/pounds/euros/rubles is being shuttled around.
Well, if the U.S. loses they have to eat the costs they spent for illegally taking the yacht

Actually in the United States law enforcement can seize your house, your car and money you have on you (particularly in a car) without charge. It is called "civil forfeiture) They will sell your house, your car and take that money and share it with between the confiscating jurisdiction and the feds. Than it is up to you to go to court and demand those assets back by PROVING there was no illegal action involved with those assets. IT IS UNCONSTITUTIONAL to do this but they do it anyhow

That type of bond is very common in US courts.
The plaintiff has list in court and is continuing to damage the defendant based by appealing and stretching out the time to resolve the issue.
I’m really surprised the court did not require that bond as part of the appeal filing.
The appeal does not relegated the case. It only looks at possible err in law. If an err in law is found and the err rises to a level of damage it will sent the case back to the trial court.
When looking at the appeal it is done from the view point that the trial court made no err. S
If the appeal is unsuccessful the government can get the court to order damages after the case.
By selling the asset the plaintiff reduces their future judgement responsibilities.

What none of the governments seem to realise is when they confiscate a yacht they have to get it out on charter straight away or it turns into a white elephant with a massive appetite for cash.
If I were the owner of a confiscated yacht I'd be having a quiet conversation with the captain along the lines of, "you know that really expensive maintenance we've been putting off, well tell the 'new owner' it has to happen now or it will be illegal to sell the boat."
I suspect confiscated yachts won't resell well – billionaires are likely to boycott them to avoid making future enemies in the billionaire class.
The reason why the US is doing this it's because US law under seizure regardless the seizure or the asset cost is most generally used cars vehicles in pleasure boating with the United States that has little to no resale value because it's titled as a branded title with United States it's equivalent to have a salvage title on a on either a vehicle or a pleasure boat a branded title is a difficult thing to ensure for its full value smart people stay away from branded titles and Salvage Title stuff because if there's a problem such as an insurance claim the insurance company is going to pay out Pennies on the dollar it's just not a good way to operate not saying people don't make these type of purchases there's two types of Smart Ones in the not so smart The Not So Smart Ones to figure out after they acquired it that it's difficult to get insurance on it in most occasions they dismantle it and sell it off for whatever they can get and in other cases they just simply don't ensure it when it's all said and done it's a lose-lose proposition with the United States taking possession of the superyacht if they go through the courts to get the title reassigned it will be as a branded title if you acquired enough common sense to be able to be in a position of acquiring a super yacht you're smart enough to do your due diligence that's why the US courts want them to Ringling ownership by pressure if the owner of the vessel signs it over then it keeps a clean title whoever owns this vessel knows all about the US law I can't imagine anybody from any country agreeing to sign over ownership the true vessel owner would be better off letting the US do what they do and finding out no one wants to acquire it and then at some point in time buying it for pennies on the dollar what chances are that person has a much Financial Resources they just simply move on chalk the whole experience up to a lesson learned.
I'm speaking from experience a family member had a child that had a little bit more money than sense came into a little bit of money and he decided to purchase an $80,000 Mustang GT one of them rare kind of one off cars just as some young people do with making poor choices thought it'd be a good idea to drive on a suspended license and smoke pot in the car not a super bright individual I ended up helping with attorney fees to try to get himself out of this fine mess with the understandings he was going to pay me back and we all know that story he continued to make poor choices my only recourse was fighting a state within the United States to gain access to this car for I can turn around and sell it and get my financial poor choice Financial I finally got the car however the state and the federal government rebranded the title simply as a branded title and when I tried to sell the car to recuperate my own poor choices the best that anyone would offer me was about 20% of the full value is sat on every known website online for sale for about 9 months I'm an old hot rod Gearhead in my mid 50s this particular car did not interest me in the least bit about the only thing that car could do was go fast straight I'm a bit into older nostalgic hot rods with a whole different type of motor more like a 600 plus cubic inch aluminum block in either a blower or Turbo just a wee bit faster than a stock showroom floor Ford Mustang I was not in the financial position to sell the car for 20% of the value after all I did make a extremely poor choice in helping a family member I do have a pretty nice shop with some car lifts so some of my friends and I One Day put the car up on a rack after we took some videos of the car operational with all the computer readouts the car only had about 6,000 Mi on it we documented the car well and then over a course of several nights I don't know maybe a week or two the car was fully dismantled and I started creating up parts and selling it online not sure if I came out ahead or not not that I had a huge labor bill all I did was provide the entertainment and drinks and dinners for my friends raw car guys we did a really good job at dismantling this vehicle we didn't put a scratch on the bad Larry all in all I got all my money back plus the interest more importantly Lessons Learned two key takeaways never helped out a family member that decides doing recreational drugs is a good idea in the second take away is stay away from a rebranded car or any type of title just when we get old enough we thought we learned just about everything and thank God teaches us a valuable lesson this has been in my rearview mirror for a couple years now there's not a situation where I ever get tied up with a branded title on anything I don't care couldn't understand why their son was more important than the car for me I had to spell it out black and white generally when people get in a difficult position in life regardless who you are or what you are or what country you're from we're all the same we realize with ourselves we made a whole host of poor choices and it's time for us to get our act together generally you'll find people that will have faith in you and assist you in you helping yourself sad to say that this young child he was in his late teens he stole a child because if you think like a kid and act like a kid you're a kid I told my sibling help starts with you help yourself and that's goes for everybody this child of yours has no interest in helping himself all the help and money in the world won't fix the problem I told my sibling I'm switching to recovery mode I'm doing what's best for me I'm trying to recuperate Financial losses from my own poor choices this goes for me just as well as it goes for him help starts with yourself this is me helping myself everybody makes poor choices from time to time some poor choices are bigger than others it's up to oneself to take themselves out of the mess they created for themselves when you do this you find out it's best to mind your own business glad the report my days are helping individuals that continue to make poor choices are over it was a good lesson learned for my three boys they knew exactly what was going on I use that as a positive influence on what not to do I let all three of my boys know if you ever get yourself in a mess like this don't call me you're going to have to figure out the best way you can on helping yourself I'll never be involved in a situation like this again because I'm smart enough to know stay out of trouble personally Lessons Learned life is funny all we can ever do is just look back at our past and Shake our head!

Seizing yachts has been one of the most disastrous abandonments of centuries of norms of international laws and the US government clearly is trying to find a way out of paying the upkeep of these ships. I suspect the next step will be to nonsuit these cases.

As long as the maintenace costs remain lower than the value of thew yacht, there is no problem for the us government. They have already won one case, if they win the appeal they can simply sell the vessel and recover their money, plus a huge profit. If they lose the appeal then they can retain possession of the yacht until all their costs have been recovered from the so called owner. Simples.

According to an article last year in Megayacht News, the USDOJ has spent since the Amadea's seizure in Fiji in 2022 some $5.6 million in drydock and repair fees in Washington and $1.7 million in yearly costs for crew pay and insurance premiums as of 2024. The American taxpayer cost so far for owning this $300 million super yacht so far is approaching $10 million, according to the USDOJ's lowball accounting of expenses. This civil forfeiture case is a minefield, with the rightful oligarch ownership of the yacht in dispute and then there is Fiji's questionable role in grabbing the yacht. The USDOJ auction of this super yacht seems a long and expensive way off.
