Now the Yacht doesn't have the right of way , the right off way is being taken by the vessel over taken the Yacht, by the way of taken control to pass but the vessel doing the over taken has to stay out of the way of the vessel being over taken, which he is clearly not doing, he must be in control of his and out of the Yacht he is over taken, but at the time he is ahead of the Yacht, the Yacht is now to keep out the way of the vessel that has over taken him cause he can see him clearer looking straight ahead, other vessel is not required to keep a look out behind him ,that now puts all responsibility on vessel behind, but by maritime law the vessel doing the over taken, is in trouble do to breaking the speed of entering port cause not to exceed the 5 not speed limit also was to close to the other vessel, aloud to pass but breaking speed in doing so, and almost hitting other vessel, so broke 2 laws when maken the attempted pass , this what is wrong , but the Yacht has no right of way ,he passed him on the proper side must be port to starbert cause showing he can see better on his tack over if he did it on a passing port to Yacht starbert, wrong, overtaking would then be wrong side and then 3 wrong, so didn't pass 100% right but did on right side starbert to port to keep good view for control, still Yacht doesn't have right of way cause Yacht can't see him right, to have right of way , still the vessel doing the passing has 3 inveracktions the way done in his passing, speed, to close & didn't sound his horn to show his intentions, hope not said to hard to understand but is right ,slow them down!!!
But who's more nimble and faster reaction time the littler boat ex Ferrari passing a dump truck on the roadway there's a matter if he has a right away or not The Ferrari's faster and nimbler so you want to go around him that's what this dude did in his boat that's all it is it's just on the water

The fishing boat gave way to the stand on vessel (larger yacht). no rules were broken here. It was all legit. If I were in the fishing boat, I too would have passed the larger yacht so that I wasn't in their wake when we entered the channel.
