  1. There should only be one Masters ticket, and only one Captain. In maritime law, the owner cannot be responsible for lives, only the Captain. So QED. If an owner does not understand that, the Captain (and crew) should probably look elsewhere. BUT. Virtually all yacht owners are successful and dominant characters. Some less professional than others perhaps. So a smart Captain should lay out a number of scenarios to the owner very early in the relationship.

  2. The owner is in charge and the owner outsources certain disciplines like ship safety, ship operations etc. However at any time the owner has the executive authority to make final decisions period. What does that mean?
    It means that although the owner gets final say, it might come with consequences that are immediate or delayed. If the owner say it’s time to depart because the owner wants to stay on schedule but the captains assessment of the sea state leads the captain to refuse the owners demand does not mean the captain has equal power. All the captain can say is no. The captain is saying no to the use of the highly technical skills the captain has. However, the owner is left with 100% authority to decide on next steps. Do the owner have access to another captain that has a different safety outcome and is willing to sell the services to the owner to depart. The point is, the captain looks like they have power because of the skill set they have. But that’s not power, the captain would say the owner is acting in a breach of trust and their fore the captain is willing to cancel said services. That’s not power the captain is using. Power can be seen in the decision that comes as a result from a captain not being on the same page as the owner. Notice what is not said….. the owner must be on the same page as to be approved by the captain. No…. Absolutely Not.
    You would hope the owner is reasonable and responsible and of solid mind. However if they are not…. The law does not give captains authority to force owners into decisions good or bad that is longer than it takes the owner to replace the opposing captain.
    Power and authority goes to the property owner period.

  4. You work the boat as if you own it because that is how a smart owner operates. His operation that produces his wealth probably has the same feel, once again, because that is how a smart owner/CEO creates amongst his employees/crew.

  5. When you first ask the question, the captain. Period. If there is any conflict, because of saftey,k the captain has the final says. Period. If it goes to hell it is the captain who can spend years in jail. Italy handed out MANY sentences for Costa Concordia, but they were ALL suspended except the captain who got SIXTEEN YEARS in jail. That said, outside of a conflict of interest in terms of operational safety, the captain is there to facilitate the requests and ideas of the owner.

  7. The Captain is in charge. He is accountable and responsible for the safe handling the vessel. Obeying and knowing the maritime rules no matter where that vessel goes. The crew, passengers and the vessel are his responsibility.

  8. captain has day to day responsibility but if the owner disagrees then they fire you but in the instant the captain has responsibility and ultimate decission

  9. It’s always the owner who has the last word, but the owner needs a captain who knowes his job, safety and takes care of the vessel. So basically it’s a team work. It has to be bethin trust. Since the captain is working on the boat, he needs to decide who is in his team, since he is also liable with what happens on the boat, and during the charter. So I am confirm complete with what you said.

  10. Not a ship captain, but the relationship between owner and crew is the same dynamic really. I've been a pilot for 40 years and for the past 22 years I've been at the Airlines. So this is a different situation because I never see the owners, I flew for 14 years at a major carrier in Japan and I never saw anyone from upper management. Before my airline career, I flew corporate for a couple of decades so I am familiar with this chemistry between a very wealthy owner and the pilot. I always started a new job by letting the owner know that the only way that I would advice against doing a flight is when it is plain dangerous to do so. That way when the inevitable "let's go " came, I could always remind him of that conversation we had. One time I told an owner "I realize that you need to be there, but please understand that I don't have to risk my life nor yours to take you there , I rather just quit now" and that took care of it. But it is a very difficult relationship for sure…

  11. I think while the “owner” is the boss, that it’s a partnership and they work together to cover different aspects of the operation.

  12. Concerning e"the comments about "making the crew feel like they own the yacht", like in everything, there are limits I guess. I am reminded of a story concerning the late Aristottle Onassis, perhaps the first of the "high profile" superyacht owners, with his converted 325 foot motoryacht "Christina". Apparently on one occasion years ago, a crew member smashed one of the two highspeed Riva motor launches carried as tenders, on an uncharted rock. Onassis merely shrugged his shoulders saying, "Accidents happen ". Sometime later Aristottle Onassis witnessed on of the many deckands employed aboard spitting on the deck. The offender was immediately apprehended, confined to his quarters and put ashore at the next port, losing all his benefits. The reason being that Onassis felt that he had not only "disresepected" the vessel, but indirectly insulted him as the owner as well..
    If I was in the position of owning a crewed yacht, I would encourage my crew to feel that they had a vested interest in the vessel, without actually feeling that they "owned" it..A moot point perhaps…?

  13. Thereis a question I would like to ask…Reagrding Annual Surveys of various types…? Do these have to be carried out at the vessels usual home port..? I would assume not, since there are cases , perhaps quite a few, where vessels are away from home port, for extended periods, like on a "world cruise" for example…??

  14. @ 2:00: I guess it’s like any other professional working relationship. You can’t force your accountant to break the tax laws for you, your doctor to give you a medically incorrect treatment or get your lawyer to help you break the law. You can fire them (literally or just by taking your business elsewhere), but they should maintain a level of professional integrity – and if you’re smart you should listen to them.

  15. I'm sure the owner of the vessel calls the shots but why would you hire a capt if you weren't going to defer to them in matters pertaining to the boat and the crew?

    it also may depend where the boat is. owner on shore and capt in the water.

  16. Captain is in charge of the safety of the vessel and the passengers/crew. This must be in the employment contract. But there is a fine line between safety and comfort! There is also a fine line between crew competence and owner’s expectations. I would guess a Force 7 is not going to jeopardise safety of the vessel like AWOL but it would make the passengers nauseous!

  17. If I had a yacht, I'd keep one thing in mind at all times. Owning it doesn't mean I know how to run it. I hired professionals for a reason, let them do their thing so I can just enjoy owning a yacht.
    Of course, I'll never own a yacht. I get hideously seasick, which sucks because I love yachts and boats. Also, nowhere near the money for it.

  18. as far as i'm concerned the captain is in charge. I would ask for various things, but leave final decisions to the captain as he is responsible for the boat and everybodys lives

  19. The owner tells the captain what he wants and it's up to the captain to find out how to meet those expectations safety and legally. End of the day the captain is responsible for the safety of the crew/ guest and its better to be fired than to have your certs pulled/ legal action

  20. You are obviously an excellent and very experienced captain – who I’m sure would be sought after if you chose to move on. But it would be interesting to explore (or get tips on) the dynamics between less experienced captains and owners, or inexperienced owners in terms of how to attract and evaluate a good captain, or perhaps how to deal with more domineering owners.
