This is a perfect storm, freak weather, extreme localised rapidly occurring conditions, a vessel not designed to deal with this very rare precise sort of extreme localised weather, demands of the entitled rich, biggest – best – shiniest – tallest (they desire the night time at anchor red light on the mast top to warn helicopters). Hubris of the rich who went down with the boat is were it all points to, if one individual in the chain of service providers enabling the egos of these people are crucified it will be a massive injustice … lessons need to be learned, but a witch hunt is NOT the answer.

Worked on a yacht around the same size with 7 crew. When the owners and guests were on board we worked. When you got that 4 or 5 hours sleep a day we SLEPT. Sweet, delicious sleep. I still remember that feeling of hitting the bunk. Lights out zzz. Wake me and feel my wrath.
A long comment, but one that teaches us nothing… The cause of the sinking is obvious: on the one hand, serious design flaws in the sailboat, and on the other, the incompetence of the crew, who failed to take the necessary priority action, namely lowering the keel, which should never have been raised in the first place, as the water depth did not require it. But one detail that is never mentioned is that the boat's manufacturer recommended raising the keel at anchor solely FOR THE COMFORT OF THE PASSENGERS, as this reduced the force of the return movements in the event of waves and possibly the noise, if the keel was not immobilized laterally by locking jacks as is normally the case…

Center board down boat probably survives as it should turn into the wind. I have raced on boats, the largest being 66 feet and we were knocked down multiple times. I will tell most of this. You have no idea how violent and how fast this shit hits the fan and how little you can do to stop it. If the yacht rolls in its side and water starts in it is a short path to demise. Sad for the loss of life but I’m telling you most of you have no idea how scary this shit is and the fact that you do not get to experience this that often or ever…,
The engineers need to be closer regulated as for functionality and risking of people's lives.
The watertight doors on the side of the vessel and the toy garage in the back are not always engineering feats that would keep a vessel from sinking………
The industry as a whole needs to be better regulated.

The fact remains here guys the giant mast would have stilled the wind as the boat heeled if the keel was down. The rest is irrelevant really. He said she said, thought this thought that. The keel should have been down knowing high winds were expected.

Was the lifting keel up or down when boat sank? If it was up, I say crew mistake, if down weather and design is to blame.
The mast height and width provides as much area as an actual sail. Without the ballast of the keel, the ship cannot right herself. IMO
Sailing Yacht with that big must, and point of stability at 70 degree is not trustworthy. I’m sailing for decades and would never ever sail with a yacht with vanishing stability less than 100. It’s crazy and very arrogant. Especially from yacht builder to put that kind of boat on the market.
Piece of sh*t design. Should have been designed as a ketch with a MUCH smaller companionway that could have been closed off in nasty weather. Also what about those HUGE hatches? Also no ballast I mean how STUPID is that? And finally why the gigantic mast I mean this thing had SIX SPREADERS!!!

I’m a Chartered Professional Mechanical Engineer assuming I was the Captain or prospective owner of this vessel – I would want to study the information on the self righting moment of the hull if it were ever “knocked over”. This self righting moment is part of the intrinsic safety the designer of the vessel must ensure is more than adequate. An independent assessment of these parameters IMHO would be mandatory. The keel being retractable only further complicates safe operation. Common sense is thrown away when the keel is not lowered, simply because the guests don’t like the noise. Also believe another serious design flaw is the flooding of a large lounge should the vessel heel over to 30 degrees, this would seriously affect the vessels ability to self righting. Stop blaming the crew when IMHO there is a complete comedy of errors in design – safety appears to have taken a back seat.

I find it disgusting that they're still trying to blame the crew. It was obvious from day one to anybody with connected cells that a combination of a freak weather phenomenon and a 'sub-optimal' ship design led to the sinking. The CEO has been a PO* from day one, a lot of other powerful people in Italy have been deflecting any possibility of an error in design and trying to throw the crew in front of the bus. I'm thankful that there's a lot of data available to investigators, both video and systems data logs that will, as eSysmen points out, exonerate the crew of gross negligence for nonsense like it was already flooding, they left the 'toy door' open, etc. otherwise there's a good chance they could have spun enough BS to charge the crew.

E' anche vero che un vento molto forte laterale può aver inclinato lo scafo tanto da mandare una delle murate sotto il livello massimo e in quel caso la quantità di acqua imbarcata diventa enorme e il vascello puo affondare in pochi minuti. E' probabile che il capitano sia andato in tilt

The design may have been faulty, but at present there is no evidence of such high winds to sink the vessel. Yes, it could have been a tornado/waterspout, but no wider than that due to the other anchored boat
